Terms and Conditions apply for all walks and lectures

General

Jason Wordie conducts his business through his wholly owned company, Angsana Limited.

Payment

Website Walks

Payment must be made in advance for all Full Day and Half Day walks to guarantee the booking.
Cancellation Policy:
More than 72 hours prior to the event – Will incur 30% administration charge
Cancellation within 72 hours of the event – 50% refund applies
Cancellation within 48 hours of the event – No Refund – FULL fee applies
Cancellations made by the attendee, on behalf of any attendee, must be made in writing and acknowledged by us.

Cancellations By Us

In the event of any cancellation of an Event made by Us, for whatever reason, each participant will be refunded in full.

Cancellations Due To Weather

Walks will be automatically be cancelled in the event of a Typhoon Signal No. 8 or a Black Rainstorm. Participants must be aware that walks are, by definition, a weather-dependent outdoor event. Given the vagaries of weather conditions in Hong Kong, localised weather circumstances may change quickly, regardless of forecast weather conditions on the day.

In the case of unsuitable weather conditions each participant will be contacted prior to the Event, in general no later than 07:00 on the morning of the scheduled event or two hours prior to an afternoon walk. Notification will be by email and SMS.

The final decision whether or not to go ahead with the scheduled walk remains at Our sole discretion. In general, a re-scheduled date will be arranged, and those participants registered for the cancelled event will have priority for re-registration. Full refunds will be offered if no satisfactory new date can be accommodated.

Fees, Costs and Charges

All fees, unless otherwise stipulated, are on a per person basis and remain unchanged upon receipt of a booking confirmation.

Corporate Lectures and Walks and Private Bookings

Full payment must be made in advance at the time of booking in accordance with these terms and conditions and in accordance with any additional terms specified on any invoice.

Full payment must be made within thirty (30) calendar days from the date of the invoice. Failure to do so will result in an additional ten per cent (10%) late payment charge, which will be compounded by ten per cent (10%) for every thirty (30) calendar days thereafter up to ninety (90) calendar days from the date of this invoice.

In the event of cancellation up to 14 days before the event 50% of the fee will be chargeable. Within 14 days of the event there will be no refund and the full amount will be charged. For walks and lectures booked on Public Holidays in the event of cancellation up to 30 days before the event, 50% of the fee will be chargeable; wiithin 30 days of the event, there will be no refund.

Personal Fitness

Each participant must be responsible for ensuring they are in suitable physical condition for each walk/trip/excursion. If you are in any doubt about your level of personal fitness please contact your doctor. Each Event may require some walking.

•Hong Kong urban walks are for approximately three hours.

•Macao, Battlefields and New Territories Walled Villages are full day excursions.

Please wear sensible footwear at all times, bring a hat if necessary, and carry a suitably filled water bottle and insect repellent.

Liability and Personal Accident Insurance

All information provided on Our website is correct, to the best of Our knowledge, errors, omissions and exceptions not withstanding. We do not assume responsibility or any liability for any participant’s own misunderstanding or misinterpretation of information provided on this site.

Responsibility and liability for the arrival and departure of any participant, rests completely with the participant. All Events are undertaken at the participants’ own risk. We accept no liability or obligation in the event of illness, injury, death or loss or damage to personal property.

Any medical condition or medication being taken that might effect a participant’s health or participation must be notified to Us in writing prior to the Event and must be accompanied by a Doctor’s certificate to verify your fitness.

Personal accident insurance is strongly advised.

Food and Beverage

All food and beverage consumed during an Event is the responsibility and cost of the participant. We accept no responsibility or liability in this instance.

Personal Conduct

We reserve the right to refuse a participant to attend if his or her or their actions are deemed to be a risk to themselves, or pose a risk or nuisance to others.

Photography

We reserve the right to photograph or film or record any Event and the relevant participants and to use any such images for our promotional and or commercial purposes, without further recourse or compensation.

Walk Notes and Other Materials

Walk notes and other materials supplied to participants, whether in hard-copy, electronic format or any other form, are under the personal copyright of Jason Wordie, without limitation, and are not to be reproduced in whole or in part, or distributed to any “Third Party” in any form whatsoever, without the express written permission of Jason Wordie as the copyright holder. Any breach of this condition will result in immediate civil action.

Agreement to Participate

By submitting this booking form I declare that I have read, understand and agree to all of these conditions and I understand and am aware that during an Event certain risks and dangers may arise, including but not limited to the hazards of traveling in unsafe areas or under unsafe conditions, the hazards of traveling in politically unstable areas, the dangers of civil disturbance and war, the forces of nature, political unrest, acts of lawlessness or terrorism, and accident or illness in remote regions without means of rapid evacuation or medical facilities. In consideration of, and as part of the payment for, the right to participate in the Event, I have and do hereby expressly assume all of the above risks which are personal to me and not to Jason Wordie or Angsana Limited. This shall serve as a release and express assumption of risk for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me for the Event.

I have also read and fully understand all parts and the legal consequences of these terms and conditions and I hereby agree that neither Angsana Limited nor Jason Wordie shall assume any liability, to the extent permitted by Hong Kong law, in contract or in tort for any injury, death, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond Angsana Limited and or Jason Wordie’s control, or which are not preventable by reasonable diligence on Angsana Limited and or Jason Wordie’s part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather or acts of God, except where such injury or death, in the opinion of the Hong Kong Courts, is caused by either Angsana Limited or Jason Wordie’s own negligence and I also agree that neither Angsana Limited nor Jason Wordie shall assume any liability for any acts, omissions or default, whether negligence or otherwise, of any Third Party and I hereby agree to fully indemnify Angsana Limited and Jason Wordie accordingly.

Disclaimer

Each participant accepts that neither Angsana Limited nor Jason Wordie is a Hong Kong licensed travel agent and accepts that neither claims or represents themselves to be.

Neither Angsana Limited nor Jason Wordie will be involved in providing services to any individual other than participants who are Hong Kong residents, since the services provided through an Event are only for the benefit of Hong Kong residents.

Neither Angsana Limited nor Jason Wordie will be liable to a participant for any loss or damage including without limitation indirect or consequence loss or damage not least if any non-resident Hong Kong participates in any of the services or events provided by Angsana Limited and or Jason Wordie.

This agreement is subject to Hong Kong law and each user of this website now agrees to submit to the non exclusive jurisdiction of the Hong Kong Courts. By booking with us and by using our website, you unconditionally and irrevocably agree to all above terms and conditions.
